Bidygo (also referred to below as the "Firm," "we," "us," or "our") is committed to safeguarding the privacy of visitors.
This User Privacy Statement applies to your use of Bidygo.com website and all Bidygo applications,services (including payment services), products, and tools (collectively the "Services"), regardless of how you access or use these Services, including access via mobile devices and apps. This User Privacy Statement also applies if it is referenced via a link or in a similar manner, such as on the websites of partners who offer Bidygo Services. By using Bidygo Services, you are consenting to the practices described in this Privacy Notice. We may change this User Privacy Statement at any time by posting the revised User Privacy Statement on this website or in Bidygo application and the effective date of the revised User Privacy Statement. You will be notified of any material changes to this User Privacy Statement via My Messages in Bidygo application and/or by email. In this Privacy Statement, “Personal Data” means information that (either in isolation or in combination with other information held by the Firm) enables you to be identified as an individual or recognized directly or indirectly. With respect to California,Colorado, Connecticut, Utah, Virginia residents, references to "Personal Data" in this Privacy Statement means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, subject to certain exceptions set forth in the California Consumer Privacy Act, Colorado Privacy Act, Connecticut Act concerning Personal Data Privacy and Online Monitoring, Utah Consumer Privacy Act, Virgin Consumer Data Protection Act.
Unless we specifically state otherwise, the Firm is the data controller in relation to any Personal Data that the Firm processes about you and is therefore responsible for ensuring that the systems and processes we use are compliant with data protection laws, to the extent applicable to us, including but not limited to, European Union General Data Protection Regulation, and the California Consumer Privacy Act of 2018. This Privacy Statement sets out the principles governing the Firm’s use of Personal Data that we may obtain about you, how the Firm collects, uses, and otherwise processes your Personal Data as well as the rights that you have in relation to our processing of that information.
COLLECTION OF PERSONAL DATA
The information we collect and learn from customers helps us personalize and continually improve Bidygo services. One of our goals in collecting personal information from you is to provide an efficient, meaningful, and customized experience. Here are the general categories of information we collect:
● Information You Give Us: We collect your personal data (i) directly from you (e.g., when you contact us, when you use our Services, create a new Bidygo account, provide us with information via a web form, add or update information in your Bidygo account, participate in online community discussions or otherwise interact with us; You can choose not to provide certain information, but then you might not be able to take advantage of many of our Bidygo Services. (ii) in the course of our relationship with you (e.g., if we provide advice to you or in the course of corresponding with you);
● Information from Other Sources: when you make your Personal Data public (e.g., if you make a public post on social media). We also collect personal data from other sources (such as credit agencies or bureaus, and data providers).
● Automatic Information: We receive and store certain types of information automaticallywhenever you interact with us. For example, like many websites, we use "cookies" or other unique identifiers and we obtain certain types of information when your web browser accesses Bidygo.com or advertisements and other content served by, or on behalf of, Bidygo.com on other websites.
● Information from Other Sources: We might receive information about you from other sources and add it to our account information. Examples include, but are not limited to, updated delivery and address information from our carriers and information from credit bureaus, which we use to help prevent and detect fraud.
● Via Mobile App. When you download or use apps created by Bidygo.com, we may receive information about your location and your mobile device, including a unique identifier for your device. We may use this information to provide you with location-based services, such as advertising, search results, and other personalized content. Most mobile devices allow you to turn off location services.
Although you are not required to provide any Personal Data while visiting our Website, you may choose to do so by completing requests for proposal forms. Should you do so, we may, for example, keep a record of your name, email address, and any other information you voluntarily provide to us.
Personal data you provide when using our Services or creating a Bidygo account.
● Identification data: Name, surname, address, telephone numbers, email addresses, your username, or your tax identification number that you provide when setting up your Bidygo account or at a later date. In some cases: age, gender, country of birth, nationality, employment status, family status, interests, and preferences.
● Payment data: If you use our payment services as a seller, additional identification data (such as social security number or date of birth), tax identification numbers (such as VAT identification number), and other information (such as bank account number) that you provide when using our payment services as a seller.
● Transaction data: Data regarding bids, purchases, or sales that you provide in a transaction. Shipping, billing, and other information you provide, as well as information required for customs clearance (such as tax identification numbers or other identification numbers) and relevant shipping information (such as shipment numbers and tracking information) if shipped through one of our programs.
● Content data: Content that you share with other users through our messaging tools.
● Financial information: (e.g. credit card and account numbers, transaction details, and form of payment).
● Through our web forms or by updating or adding information to your Bidygo account, by participating in community discussions, member chats, surveys, inquiries, dispute resolution, or by recording customer service calls with your consent, you may provide us with additional personal information.
● Other data that we are required or entitled by the applicable law to collect and process and that we need for your authentication or identification, or for the verification of the data we collect.
● Cookie and device data: such as information about your visit to our Website, IP address, device identifier, browser type and version, operating system and network, location and time zone setting.
USE OF PERSONAL DATA
We will only use your Personal Data if and to the extent the applicable law allows.
For example, we process your personal data to provide and improve our Services, to provide you with a personalized user experience on our website, app, to contact you about your Bidygo account and our Services, to provide customer service, to provide you with personalized advertising and marketing communications, and to detect, prevent, mitigate and investigate fraudulent or illegal activity.
The purposes for which we use Personal Data, and the legal bases for such processing, are as follows:
● To purchase and provide products and services: We use your personal data to contact you regarding the acquisition and processing of orders, the provision of products and services, the processing of payments, orders, products and services, and the provision of promotions. Provision of our Services, including but not limited to enabling and performing transactions with other users (including the transmission of your personal data to other users where necessary to perform the transaction, including in cases of terminated, failed or subsequently voided transactions, e.g. by sharing your return address so a buyer may return an item), displaying your transaction and feedback history to you, providing and enhancing features such as payment processing, ratings and Bidygo account management, providing other services you may use (as described in connection with such services), and ensuring the functionality of our Services. In connection with the provision of our Services, we will send you notifications relating to the execution of transactions and the use of our Services in accordance with the communication preferences in your Bidygo account.
● To Communicate with you: We use your personal information to communicate with you in relation to Bidygo Services via different channels (e.g., by phone, email, chat).
● To provide relevant marketing, We use your personal data to recommend features, products, and services that might be of interest to you, identify your preferences, and personalize your experience with Bidygo Services.
● To address compliance and legal obligations, such as complying with the Firm's tax reporting obligations, checking the identity of new clients and to prevent money laundering and/or fraud we use identification data, transaction data, compliance data and device data. This processing is necessary for the purposes of complying with legal requirements that apply to the Firm. For example, we collect from sellers and buyers information regarding place of establishment and bank account information for identity verification and other purposes.
● To receive goods from other users. If you provide us with your address by indicating that it’s “Public”, other users can see your address information. Note that it will only be possible if you indicate your address “Public”.
● To improve our Website/App, we use cookie and device data. This processing is necessary for our legitimate interests to constantly monitor the functionality and user-friendliness of our Website and improve our online presence and services to you.
DATA SHARING
We may disclose your Personal Data in accordance with applicable law and subject to applicable professional and regulatory requirements regarding confidentiality and professional secrecy. We may disclose your Personal Data to:

Access. Subject to certain exceptions, you have the right to request a copy of the Personal Data we are processing about you, which we will provide to you in electronic form. At our discretion we may require you to prove your identity before providing the requested information. If you require multiple copies of your Personal Data, we may charge a reasonable administration fee.
Rectification. You have the right to require that any incomplete or inaccurate Personal Data that we process about you is amended.
Deletion. You have the right to request that we delete Personal Data that we process about you, unless we are required to retain such data in order to comply with a legal obligation or to establish, exercise or defend legal claims.
Restriction. You have the right to request that we restrict our processing of your Personal Data where:

o our processing is unlawful; or
so we no longer need to process such data for a particular purpose, but where we are not able to delete the data due to a legal or other obligation or because you do not want us to delete it.

CHILDREN’S PRIVACY PROTECTION
We understand the importance of protecting children's privacy in the interactive online world.Bidygo does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use Bidygo Services only with the involvement of a parent or guardian. Our Website and App is not designed for or intentionally targeted at children 13 years of age or younger. We do not knowingly collect personal information from children under the age of 13 withoutthe consent of the child's parent or guardian.
DATA RETENTION
We will only retain your personal information for as long as necessary for the purposes for which that information was collected as set out in this Privacy Statement or for longer as required under any applicable legal, regulatory, accounting, or reporting requirements.
THIRD PARTY SITES
Our Website and App may contain links to other sites which are controlled by third parties, for example in the “Insights” section. We also use social media sites, such as LinkedIn and Facebook and third party platforms to host events, training and seminars. You should review these other sites’ privacy policies. We do not accept any responsibility for the information you provide on those sites or their collection and use of your personal information.

We work to protect the security of your information by utilizing encryption methods during the transmission or storage of information you input through our websites and mobile applications. One hundred percent complete security does not presently exist anywhere online or offline, and we are unable to provide specific guarantees regarding complete security of your personal information; however, we have a team of security professionals that work to safeguard your information.
We protect your personal data through technical and organizational security measures to minimize the risks associated with data loss, misuse, unauthorized access, and unauthorized disclosure and modification. For example, in addition to firewalls and data encryption, it uses physical data center access restrictions and data access authorization controls.

RETURN AND REFUND POLICY
This Return and Refund policy (hereinafter referred to as the “Policy”) is an integral part of Term of Service and a separate legal document, binding on Bidygo.com (“Bidygo”) and our customers. It outlines return and refund procedures, parties’ rights and obligations and other selling – buying provisions related to the sale of products.
Bidygo has the right to change this Policy at any time, having regard to the legislative requirements.
Although the returns policies for Marketplace Sellers may be different from Bidygo’s return policies, we have set up certain minimum return standards to ensure a consistent customer experience. Review the following guidelines to confirm your return is eligible.
GENERAL PROVISIONS
Although we have made every effort to display the colors, images and descriptions of products as accurately as possible, upon delivery the customer can open the product immediately to check its compliance with the qualitative and quantitative features presented on the Bidygo website or App (“Website”,“App” ).
Purchased products are eligible for return except for lingerie, underwear, earrings, medicine, grocery items, gift cards, fresh flowers, live indoor plants, pet food, similar products and other products mentioned non- refundable in the product description. With regard to the products provided as an exception, once the product is shipped, it is considered purchased and cannot be refunded. All risk of loss and damage to the product passes to the customer upon delivery.
Taking into account the customer’s previous purchase history, the products provided as an exception may, at the discretion of Bidygo, be eligible for return.
Ensure you enclose the correct and complete item when making a return. The correct item must be returned to receive a refund. If you accidentally sent the wrong item, we will do our best to locate this item, but Bidygo.com is not liable for any item(s) that are returned to the seller in error, and we cannot guarantee that we will be able to locate the item. No compensation is provided for incorrect items sent to the sellers.
Returns are accepted within 14 days from the day of receipt of shipment. [AS1]Customers are responsible for all return shipping charges unless the product shipped is damaged on delivery. Once your return is processed, you will receive a refund for the amount paid for the returned item back to the original method of payment. Any outbound shipping charges paid will not be refunded if the order is returned. It can take around two weeks for your return package to reach sellers and be processed by the seller's returns team. You will be notified by email once your refund has been applied. The refund will be applied to the credit card or other method of payment initially used to make the purchase. Please note that depending on your financial institution, it may take an additional 2-10 business days after your credit is applied for it to be reflected on your statement if you used a credit card (up to 30 days for internationally-issued cards).
All merchandise must be unworn and in the same condition it was received. Some items ship with an attached security tag. Merchandise returned without the original security tag attached or a damaged tag may not qualify for a refund. Products must be returned in the original box and/or packaging. The original packaging contains a bar code that helps us identify your items with your order, so your account can be credited successfully. Customers may be liable for loss in value of the item if it is returned in a different condition from which it was received, or if the item is not packaged securely to prevent damage in shipment. In the event that an item is returned in used or damaged condition, some sellers might provide a partial refund to account for the loss in the item's value or not refund at all. This applies when the loss in value is due to handling of the goods which was not necessary for checking the condition, properties, or mode of operation.
DAMAGED ON DELIVERY
If you receive your purchased item and it has been damaged during shipping, please contact us within three (3) days of receiving the shipment. Please include a description of the damages and pictures. This information is extremely helpful to us in making sure that our products are packaged and shipped properly. We will arrange for the damaged products to be replaced or refunded.
During the busy holiday season we try our best to guarantee your order will arrive on time, but due to extremely high order volume and unexpected weather situations beyond our control, there might be a slight delay in delivery of your order. If we miss our delivery guarantee due to an error on our part, we will refund your shipping. Understandably, no refunds can be issued for orders delayed due to adverse weather conditions or any unforeseen circumstance that may affect our shipping carriers.
If it turns out that the defects arose after the transfer of the product to the consumer, or the actions of third parties, or force majeure, sellers are not liable for refund and will not accept returns.
